Ius Commune promovendiopleiding 2020-2021. Comparative Law Research and Methodology
Online, dinsdag 18 en woensdag 19 mei 2021 Introductie - Programma - Instructies - Contact IntroductiePostgraduates who are engaged in comparative law research tend to encounter, at least in the beginning, many theoretical and practical problems. Which systems will I include in my research? Which sources must I consult? Can I find all the necessary materials in the Netherlands or do I have to obtain them from abroad and, if so, from where? For the research are there any other reasons for going abroad? Within the system researched what is the relationship between legal literature and case law, between commercial law and civil law, between federal law and the laws of the Member States?; what are the basic outlines of the judiciary system?; are there any impending amendments? What is the importance of legal history, Human rights law, EU-law, or any of the harmonization projects like e.g. the DCFR on my comparative research? Also more practical topics will be addressed: is it advisable to publish my thesis (or a preceding article) in English? How do I translate certain (legal) terms?These and many other questions will be dealt with during this exceptional Ius Commune distance course for PhD candidates from the Ius Commune postgraduate Research School which will be organized by Utrecht University and the Molengraaff Institute for Private Law in May 2021 – Tuesday 18 and Wednesday 19. The lecturers are all comparative lawyers with a great deal of experience and a wide reputation both at home and abroad. The candidates will have to prepare a short expose on the use of comparative law in their research; the teachers or other experienced researchers will provide reflection. This reflection will be in electronically spoken form at the scheduled date (MS Teams), and/or in a written form – with obviously always the option to personally contact by email, also afterwards. InstructiesParticipants shall two weeks in advance of the course submit a methodological issue relating to their research in the form of a short and concise paper (max. 1000 words). Briefly address the topic of their thesis, the legal systems chosen (and why) and – very important – the specific issue concerning comparative methodology you would like to see addressed .
