Abstract:

This thesis examins the concepts of ownership and cultural property as part of cultural heritage. It seeks to adress the potential conflicting characteristics of exclusivity and alienability of property rights and the social and inalienable qualities of cultural expressions. Part of the thesis will contain an overview of leigislation on the protection of cultural heritage and the trade in cultural property, and the implementation in the national law of the Netherlands, as compared to France and the UK.
