Abstract:

During this research I will investigate modern rules pertaining to the transfer of movables, undisclosed property rights and assignment of claims (especially with regard to modern instruments of finance and security), in order to determine what scope is left for the principle of publicity in Europe. I will discuss the relationship between publicity and the protection of third parties and examine the opportunity of implementing a system of registration for security rights as used in the United States
