Abstract:
The focus of the research will the functioning of the European Unions Emissions Trading Scheme (ETS) within its multi-level institutional setting. Attention will be paid to several distinct phases of the ETS including: transposition of the European legal framework into national laws, practical application of the resulting National Allocations Plans and the consequent compliance and enforcement dynamic between the European Commission and European Court of Justice, Member States and regulated parties. The normative questions of the research center around the extent to which the current scheme is able to fulfill the goals set out in its founding directive: effective and efficient reduction of emissions and achieving of the Kyoto commitments. This research will touch on many, if not all, of the current research areas of the Center for Environmental law. The market for emissions will be subjected to close scrutiny in order to ascertain the effect of new instruments developed to deal with climate change. Moreover, the role of the European legislator and the effects of European law on the national legal order, harmonization issues (decentralized versus centralized governance), the role of the individual and interaction between compliance and enforcement are themes which will be discussed.
