Abstract:
The economic analysis of law enforcement has made clear that public and private enforcement schemes have a number of strengths and weaknesses. If the goal is to achieve optimal deterrence, a mix of public and private enforcement will be needed. So far, the Law and Economics literature has remained rather vague about the precise content of such an optimal mix. The proposed project seeks to fill this gap by developing more specific criteria for selected areas of consumer law. These criteria will then be applied to existing systems of enforcement in selected EU Member States.
