Abstract:

TRIPS compliance requires India to square the ideological differences in construing test data as both public information goods and private property through an appropriate techno-legal-policy instrument. This instrument is expected to have a tremendous bearing on multinational R&D investments including contract research deals, generic exports, national public health policy and new levels of competition in the life sciences market. Also, Indias position as a well informed negotiator in Free Trade Agreements that usually mandate data exclusivity requires to be seen in the next few years. Perspectives surrounding the creation of the Indian Data protection legislation in relation to aforesaid perspectives form the crux of this PhD proposal.
