Abstract:
This research focusses on the various procedural rules that aim to determine the facts underlying procedure. I will focus on the legislations of France, Germany, the Netherlands and England. The research will have a large historical component. For each of the four legislations the fact-finding process will be studied from the 19th century onwards.
