Abstract:

The core objective of my research is to explore the area of interface between the law of property and the law of delict in which conflicts between neighbours fall, in order to identify common elements that might be shared by the categories that integrate the law of neighbours and to explain how do they operate, for the purpose of determining whether these categories nuisance, encroachment, trespass, withdrawal of support and alteration of water flow can be understood under a single, unified theory of the private law of neighbours and, more importantly, whether it is helpful that they should be understood in this way.
