Abstract:
This research project will make a comparative analysis of the role of legal counsel in civil litigation. The litigation process is often too lengthy, too costly, and ineffective when it comes to finding the truth. The question is how the codes of conduct and professional liability of lawyers (which apply to the relationship with their clients and with third parties in a law suit) relate to the procedural standards that are aimed at a smooth, efficient and effective conduct of the case. To answer this question, the research project will study recent major changes in procedural law in England, Germany and the Netherlands.
