Abstract:
This research questions whether functional jurisdiction demonstrates the existence of a (new) international law principle of extraterritorial jurisdiction to be exercised in the interest of the international community. It focuses on legal entitlements and unilateral claims of jurisdiction made by port States within the law of the sea regime. It particularly examines port State assertions of extraterritorial jurisdiction in two domains: the preservation of marine environment and the application of international labour standards on board of foreign vessels.
