Abstract:
EU Member States are free to decide by which means they want to enforce Union legislation. This leads to a complex and asymmetric patchwork of criminal and administrative enforcement in cross-border cases. This project analyses the enforcement systems in three Member States and aims to provide an integrated framework in the EU that respects the systemic differences in these Member States whilst enabling more effective cooperation in the field of punitive enforcement. In this regard, special attention is given to the possibilities that the Union mechanisms of harmonisation and mutual recognition provide.
