Abstract:
The Aarhus Convention and EU legislation grant the public wide access to environmental information. This right stands in sharp contrast to the confidentiality of information on business activities. Balancing the rights to openness versus confidentiality of information is a delicate issue that is not easily resolved particularly in non-compliance situations. This study examines the legal requirements for decision-making by public enforcement authorities through a three-part analysis a doctrinal, a comparative and an empirical. In this regard, the study tests the European Greenhouse Gas Emissions Trading Scheme in Germany and the United Kingdom.
