Abstract:
Family and tort law have a strained relation: they cannot exist with nor without each other. On the one hand, a family needs to remain free from legal discourse. On the other hand, family members need the protection of tort law and access to a liability insurance. Growing appeals to liability and insurance exacerbate this relationship. Preliminary research indicates that the role of family relationships in tort law and insurance (law) is changing. The research projects aim is to uncover the significance of a family relationship for tort law and insurance (law), by conducting comparative legal research.
