A new balance between empowerment and protection of the elderly

Abstract:
This PhD is concerned with a comparative law research into the legal instruments of several European jurisdictions which focus on protecting elderly persons who are no longer fully capable of legal decision-making. This research is part of an interdisciplinary research project that strives to formulate legislative proposals for a new system of legal regulation in the Netherlands, in which elderly persons are provided with better protection against fraud as well as with more autonomy in relation to legal decision-making.
