Abstract:

The increasing volume of Nazi looted art claims adjudicated by US courts requires a moment of reflection to critically look back at two decades worth of case law that has formed in this area, in order to gain a better understanding of the implications and pitfalls of the magnetic effect that this jurisdiction has exerted upon cases that might present a number of significant ties with European countries. From issues of jurisdiction, to those deriving from discrepancies in choice of law criteria, to problems of enforcement of these rulings, useful insights could be inferred to better prepare for future litigation.
