Abstract:
The principle of unity in property law is a fundamental basic principle of property law concerning the subject matter of rights in rem. This principle was recently embedded in the property law reform, but was already applied in the existing Belgian legal doctrine and case law. The doctorate explores the basis, operation, cases of application and (possible) exceptions to the unitary principle, and in connection with this, the principle of 'bestanddeelvorming'
(components). Legal comparison is potentially relevant with Dutch, French, German and/or Swiss law.
