Abstract:

In many jurisdictions, legislative, constitutional or international law norms curtail the state's discretion to regulate economic activities. Accordingly, state regulation of economic activity has been subject to legal standards that vary across time and space. However, no systematic analysis has been performed of how these standards compare to each other or how those differences relate to differing appreciations of the trade-offs that are involved. This dissertation therefore intends to (i) compare several key approaches in the most prominent jurisdictions and to (ii) analyse how these standards give expression to different normative goals.
