Abstract:
This research will present the impact of insurgencies conduct of war on the regulation of armed conflict due to the evolution, frequency and normalcy of its employment. It will examine the critical characteristics of insurgency warfare and the insurgents strategic goals, which will help identify the manner in which insurgency combatants weaponize International Humanitarian Law in order to achieve their endstate. In addition, this research will analyse the impact of International Humanitarian Law into the conduct of war of the state and the insurgency which may lead them to act in a particular way. Finally, this research will establish recommendations for the amendment and/or development of new guidelines in order to regulate this commonly used type of warfare.
