Abstract:

The research concerns disputes between two parents about the joint exercise of their parental authority over one or more children and the role of the best interests of the child in this as a relevant assessment framework for these disputes. The research is limited to disputes that arise after the divorce, for example about medical treatment, choice of school or the care arrangement. In addition to an outline of the national and international legal framework, the study includes a case law study that examines which factors are important in the interpretation of the best interests of the child, as well as an empirical and comparative legal component in which the current procedure is evaluated and examined whether this could be improved.
