Abstract:
This research is centered on the normative question to what extent reorganization law (as part of insolvency law) should play a role in resolving mass harm disputes, considering the various interests and policy goals underlying mass harm law and reorganization law. To this end, this research project employs functional comparative analysis and a conceptual framework (likely integrating corrective justice and anticommons theories).
