Abstract:
Transitioning from a linear take-make-dispose economy to a circular economy by all countries, including developing ones, will contribute to solving the global plastic pollution crisis. An appropriate and coherent international law framework is needed to enable this transition, as confirmed by the ongoing initiatives at the WTO and negotiations of an international Plastic Treaty. Using the case study of Latin American countries, this study focuses on three international law dimensions: international economic law, the Basel Convention, and the Plastic Treaty to analyse how they can enable and/or impede the transition of developing countries to an inclusive circular economy in plastics.
