Abstract:
Economic activities at sea used to consist only of 'floating' activities such as fishing and transport. In the 20th century, new activities such as offshore oil production became possible. Relatively recently more 'fixed'/'anchored' constructions are placed in the North Sea such as windmills. While the amount of activities and constructions on the North Sea increases, no fundamental research into the qualification of these works and constructions from a property law perspective has been conducted yet. The lack of research is not only undesirable because the qualification from a property law perspective influences matters such as ownerhsip and limited rights, but also because it influences the applicable liability regime. This research provides the needed fundamental research into the qualification of activities and constructions in the North Sea from a property law perspective.
