Abstract:
Analysis of the impact of incoming parties on ongoing proceedings. To what extent can parties at different stages of the proceedings still be involved? In turn, what influence can these incoming parties exert on the procedure? The Belgian procedure is designed from a one-to-one perspective. As a result, there is no general regulation for this type of situation, which nevertheless responds to a social reality of complex disputes involving more than two parties. Lessons from ad hoc rules within Belgian procedural law, comparative law and the consideration of general principles such as the right of defense and procedural economy will help form a more general framework.
