Abstract:
With the development of AI, personalised price discrimination appears to have grown in digital markets. It triggers competition concerns due to the potential harm to competition and consumers. It therefore raises the question of how to respond to calls for competition law intervention regarding AI-enabled price discrimination. This research intends to explore the economic rationale of AI-enabled price discrimination and to compare the legal consequences of price discrimination under EU and Chinese competition law, to provide policy suggestions to those jurisdictions for considering price discrimination as an infringement of competition law and to contribute to the legal and economic literature on price discrimination.
