Abstract:
The proposed projects aim is to lay out the fundamentals of the regulation of Third Party Litigation Funding ("TPLF) from the point of view of access to justice requirements, in particular in Strategic Public Interest Litigation ("SPIL"). This will include: - catalogue the regulatory and judicial response to litigation funding in core jurisdictions both inside and outside the EU; - investigate the requirements which the ECHR and the Charter impose upon litigation funding in the context of access to courts, in particular in SPIL cases; - draw up a blueprint for EU rules for such funding, against the background of both the EUs development of harmonised CPR rules, its extensive regulation of the financial sector, and the increasing relevance of SPIL in the EU.
