Abstract:
Over the last decade, conditionality instruments in the EU have increased both in number and in scope. Whilst cooperative conditions had always been attached to the disbursement of structural funds, conditionality frameworks today display new coercive features which represent a departure from previous models. Through coercive conditionality and the mobilisation of vast resources following the pandemic, the EU is now more capable of influencing policy in areas of the law traditionally beyond its reach, including the rule of law. This research looks at the constitutional implications of conditionality in the EU, embedding its findings in the current discussion on the transition from cooperative to coercive federalism.
