Abstract:
The European Union (EU) has evolved from a purely market-oriented project to a Union of Equality. LGBTIQA+ rights have been gradually incorporated within the Unions constitutional framework, and EU institutions seem increasingly committed to offer more robust protection to LGBTIQA+ persons. The research will investigate the precise extent of the EUs mandate to deal with the protection of these rights. It will then shift its focus to the available tools at supranational level: what instruments have been mobilised to offer legal protection to LGBTIQA+ people? The PhD project will thus critically assess the suitability of EU law for LGBTIQA+ rights protection. Furthermore, the project will focus on the substantive effects of EU legal instruments. Notably, it will examine whether the EUs commitment might also be a source of exclusion and inequalities for some categories of LGBTIQA+ people, both at EU level and in the Member States. The research will thus result in a number of legal proposals to enhance LGBTIQA+ rights protection in the EU.
