Abstract:

Mandatory Human rights Due Diligence (HRDD) is a legislative measure regulating human rights and environmental impact, directly or indirectly, in a Global Value Chain (GVC). Corporations adhere to these due diligence requirements by implementing contractual clauses in their supply chain to this end. There is a potential for a conflict between the contractual clauses implemented in the contracts along the GVC and national legislation in other jurisdictions in the value chain, making these clauses less applicable along the GVC. This research will investigate whether theoretical approaches to conflict of laws within legal pluralism could provide a solution to overcome this.
