Abstract:

The Green Deal promises a transformational shift through environmental lawmaking, yet beneath its ambitious framework lies a looming paradox: laws designed to tackle one of the three environmental crisesclimate change, biodiversity loss, or pollutionmight undermine efforts in another. This research explores how EU institutional structures shape these contradictions, focusing on the choice of legal basis and competence, legislative procedures, and the role of the CJEU. By uncovering the mechanisms that either foster or fracture coherence, this research seeks to illuminate pathways towards a more integrated and effective EU environmental legal orderone where ambition is matched by alignment.
