Abstract:
This doctoral research addresses the urgent need for a comprehensive regulatory framework to manage per- and polyfluoroalkyl substances (PFAS), focusing on integrating fundamental Environmental Law principles and Circular Economy (CE) perspectives. The study seeks to answer how fundamental Environmental Law principles and CE perspectives can be incorporated into a comprehensive regulatory framework to manage PFAS across their lifecycle, enabling sustainable and effective strategies that address their persistent and multifaceted impacts. Adopting a circular approach, the research examines three key stages of PFAS management, i.e., prevention, design and production, and the end-of-life stage, such as disposal and accountability for contamination. It explores how principles such as the precautionary principle, the hazard-based approach, and the essential use concept can strengthen preventive regulation. Additionally, it assesses the role of EU legislative instruments, such as the Ecodesign for Sustainable Products Regulation (ESPR) and the Packaging and Packaging Waste Regulation (PPWR), in promoting safer chemical design, innovation, and sustainable production. The research will further investigate how principles like the Polluter Pays Principle (PPP) and the Extended Producer Responsibility (EPR), as well as the EU Environmental Liability framework can enhance accountability and bridge the gap between preventive and restorative measures. Ultimately, the research seeks to identify key components of a legal-doctrinal foundation that harmonises Environmental Law and CE principles to effectively manage PFAS throughout their lifecycle, considering current scientific limitations and the dynamic nature of environmental and chemical sciences.
